What a copyright notice needs

To be valid, your notice has to be in writing and include:

  • Your physical or electronic signature, as the owner or someone authorized to act for the owner.
  • The copyrighted work you believe was infringed.
  • The material you want removed, with enough detail for us to find it. A gallery link works best.
  • Your name, mailing address, phone number, and email.
  • A statement that you believe in good faith the use isn't authorized by the owner, its agent, or the law.
  • A statement that the information in your notice is accurate, and, under penalty of perjury, that you're the owner or authorized to act for the owner.

What happens next

  • We review the notice and remove or disable access to the material if it qualifies.
  • We let the photographer know, including what was removed and why, so they can respond.
  • Removed material stays hidden from clients. Nothing is deleted while a claim is open.

Counter notices

If your material was removed by mistake or misidentification, you can send our agent a counter notice that includes:

  • Your physical or electronic signature.
  • The material that was removed and where it appeared before it was removed.
  • A statement under penalty of perjury that you believe in good faith the material was removed by mistake or misidentification.
  • Your name, address, and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you're outside the US, any district where we can be found), and that you'll accept service of process from the person who sent the original notice.

We forward valid counter notices to the person who sent the original notice. Unless they tell us they've filed a court action, we restore the material in 10 to 14 business days.

Be accurate

Under federal law, anyone who knowingly misrepresents that material is infringing, or that it was removed by mistake, can be liable for damages. If you're not sure whether something infringes your rights, talk to a lawyer before sending a notice.

Repeat infringers

We disable the accounts of photographers who repeatedly infringe others' copyrights. For review: Define the threshold, for example three valid notices in 12 months.
